THOMAS WINTER: When a person joins the Kaiser system, they agree to give up their right to bring a suit in a court of law for any medical negligence. Seventy to eighty percent of our medical malpractice cases are against Kaiser.
It’s important for the firm you retain to handle your case to be very experienced in Kaiser matters because you won’t be presenting the case in front of a jury of 8 or 12 people. So if the firm doesn’t have the experience to pick the right arbitrator, you’re going to be at a significant disadvantage.
